Please, before use this web site, carefully read these Terms and Conditions. By accessing and using this Web Site, you agree to these conditions and accept them unconditionally  without restrictions.

 If you do not accept the Terms and Conditions, please do not use this website.

This document contains the Terms and Conditions under which FINTRA Ltd provides services to customers through its online shop www.zoneled.de.

 These conditions are binding on all Members. Customer is informed and express consent of the same prior to the purchase of goods from the online store. By accepting these Terms, customers give explicit consent to the conclusion of a distance contract within the meaning of the Law on Consumer Protection.

 

GENERAL

Art. 1 www.zoneled.de is Web site for e-commerce in the European Union, the publication of this Website is a public invitation to contract for the purchase of FINTRA LTD’s goods. The contract is signed with the client by sending a proposal by the Customer in the form of purchase order made by www.zoneled.de, accepted and confirmed by FINTRA Ltd by telephone or email.

Art. 2. These Terms and Conditions are intended to regulate relations between FINTRA Ltd. Bulgaria, Sofia, Sofia city, Sofia Municipality, rn "Lozenets" street "Lozenets" № 36, Ap.3, UIC 131004510, represented by Mr. Dancho Danchev, Manager, hereinafter referred to as the supplier and customers (consumers, recipients of services) of e-shop www.zoneled.de.

 For Customer under these Terms shall mean any natural or legal person visiting or enjoying the website for purchase of goods offered in the online store.

Art. 3. Object of the sale are goods offered on the website at the time of making the application for purchase by customers who indicated they were available. Goods are subject to sale through the site are described in it in type and quality. Art.

4. The supplier delivers the goods and ensures clients' rights under the law in good faith and accepted in practice, consumer or business law criteria and conditions.

8. Main characteristics of the goods and / or services: the characteristics of the goods have been specified in the page for each product;

9. Price of goods or services (including all taxes): the price of the goods is indicated below each item. The price is stated in Euro including VAT;

10. Value of costs associated with the delivery of ordered items (postage and shipping costs): the cost of delivery of the ordered goods are detailed in Section VI.

When transport costs are borne by the customer (for refusing orders, etc.and other cases are exhaustively described below), the value is given in Section V and VIII.

In cases where certain items are on sale, the cost of delivery at the expense of the Customer;

11. Value of using the means of distance communication, where it is calculated in a different manner than that of the basic tariff: FINTRA Ltd does not impose additional value of the means of communication with the Company;

12. Payment, delivery and performance of the contract: they are described in detail below in Sections IV, V and VI;

13. Period for which the offer or Price remains in force: binding for both parties are the prices listed in this online store at the time of application;

14. Duration of contract:  

 FINTRA Ltd does not offer contracts to permanent or intermittent supply of goods or services.

 

III. RIGHTS AND OBLIGATIONS OF THE PARTIES

A) Rights and obligations of the Client:

Art. 6. (1) The customer is entitled to:

- To review the products, their features, prices and terms of delivery;

- To order goods from E-SHOP www.zoneled.de under the terms and conditions set out in these Terms.

- To receive the ordered goods /good/ to specified address for delivery after prior confirmation by phone or email by a representative of FINTRA Ltd.;

- To receive detailed  invoice / receipt for purchases made by him, which contains information on all purchased goods - size, color, number, unit value of each product, total amount due, the identity of the supplier, including address, phone and other contact details;

- To obtain information on the status of their orders;

- Upon delivery of the goods received to obtain  in writing the information under Art. 54 of the Law on Consumer Protection.

 (2) A client user as having the meaning of the consumer shall be entitled to all other rights under the law to protect consumers.

(3) The Customer has no right to use the website to send any content which is unlawful, false, misleading, threatening, inflammatory, abusive, harassing, defamatory, defamatory, obscene, pornographic, religious or materials that predispose to conduct that would be considered a criminal offense and can lead to civil or criminal liability or otherwise violate any law or morality. In the event that the Customer fails to comply with this obligation, he bears full responsibility for any damage to FINTRA LTD.

Art. 8. Customer shall:

- To pay transport costs where they are at his expense.

B) Rights and obligations of FINTRA Ltd.:

Art. 9 FINTRA Ltd. has the right:

- To receive all amounts due for purchases of goods and their delivery;

- At any time and without notice to make changes in the published materials, services and prices;

- To obtain from the customer the following information: name (for private individuals and family, to legal entities and sole traders - company name), address, telephone number and email address;

- To sent to the Client for express consent on his part, by mail, by phone, via text messages (sms, email or other forms of communication) or other means of addressed advertising information on current promotions and special offers new products and any other information relating to him as a client;

- Has the right to collect and use information regarding his customers in order to improve the quality of the goods and services and the satisfaction of consumer needs, and to explore satisfaction with the goods purchased and the quality of service offered;

 

- At any time, without notice to the Customer when he uses the site in breach of these conditions and at the discretion of FINTRA Ltd. to terminate user access to the site.

Art. 10. FINTRA LTD guarantees the supply of brand new products.

Art. 11. FINTRA Ltd. shall:

- To transfer of the Client ownership of goods ordered by him;

- To deliver the customer ordered products on time and in terms of delivery posted on this website and these Terms.

 

IV. CONTRACT FOR SALES

Art. 12. (1) The customer enters into a contract for sale of goods offered by www.zoneled.de, using the Provider interface, available on its website at http://www.zoneled.de. This disclaimer is an integral part of any contract for sale.

(2) Under a contract concluded with the client to purchase Contractor shall deliver and transfer ownership of the Client of ordered goods through the interface.

(3) The Customer shall pay the Contractor the price of the goods supplied under the conditions specified on page www.zoneled.de and these Terms.

(4) The supplier delivers the goods ordered by the Customer according to the terms and conditions set by the supplier on www.zoneled.de site and these Terms.

Art. 13. (1) Client and Provider agree that all statements between them in connection with the conclusion and execution of the contract of sale may be made electronically through electronic statements within the meaning of the Law on Electronic Document and Electronic Signature Act and Art. 11 of the Law on Electronic Commerce.

(2) It is assumed that electronic declarations made by customers of the site were made by persons referred to in the data provided by the Customer at the time of registration if the client has implemented the appropriate username and password.

Art. 14. (1) Provider and Customer sign separate contracts for purchase of goods declared by the Client, regardless of their chosen one electronic application and a list of goods to buy.

(2) The provider can deliver together  ordered with individual contracts for the sale goods.

(3) The rights of the Customer in connection with the goods supplied shall be exercised separately for each contract of sale. The exercise of rights in connection with the goods supplied shall not affect the operation to contracts for the sale of other goods. If the client has as a consumer rights within the meaning of the Law on Consumer Protection,the  exercise the right to withdraw from the sale of a product does not affect contracts for the sale of other goods delivered to the user.

Art. 15. In exercising its rights under the contract of sale customer is obliged to state clearly and unambiguously contract and the goods in respect of which the exercise.

Art. 16. The customer pays the price for individual contracts for sale once in the course of ordering goods.

Art. 17. Buying goods from online store is available for Customers - registered users as well as for customers who filled out data once during the order.

A) User registration:

 Art. 18. Registration on this site is free and enables customers to avoid entering personal data on each purchase and make use of the cost advantage of different customer groups. Client groups are collectively named to all partners and customers of the online store. They are used to serve all the customers simultaneously, but with different prices for different products groups - retail customers, wholesalers, distributors and other contractors. Right www.zoneled.de is to fix any registered user client group to which it belongs. Prices for a particular client group are not visible to other client groups.

To register on the website www.zoneled.de, customer must complete on-line registration form. The client is obliged to provide full, true and accurate data. In providing false or incomplete information FINTRA Ltd has the right to terminate the delivery of your order, and without notice to terminate the registration of maintaining user.

Art. 19. To register the client is required to comply with the following steps:

1. Select "Register" button;

2. Entering personal data and payment address and contact;

In case of lost (forgotten) password FINTRA Ltd sent a new password at the client’s e-mail.

Art. 21. (1) A customer who has registered in the e-commerce site www.zoneled.de, is entitled to enter into his account through these registration username and password.

(2) Through a link in his menu "Edit Profile" Client will be able to edit his personal information, change his password and the delivery address. The site does not allow changing the e-mail address of the Customer. If necessary, change the e-mail address of the Client shall be subject to new registration.

B) entering into a contract of registration:

Art. 22. (1) The procedure for concluding the contract is standard and goes through the following stages:

1. Browse models: customer enters his own account by entering his username and password and select the product he wish to order.

2. By pressing the "Buy" selected customers products will appear in the user's cart. It can add unlimited number of products, and to remove those from which the client is rejected.

3. When you select the button "Shopping" client see the selected products until shopping with photo, name of product, quantity ordered, unit price and total price. After entering the consumer space, customer can change the quantity of the selected product or deleting it from the cart, if he wishes to withdraw from the selected product.

4. Art. 23 (1) The procedure for concluding the contract is standard and goes through the following stages:

V. PRICE AND PAYMENT

Art. 24. (1) All prices of goods in online store are in euros. The prices of goods are final, valid for the day of the order and are inclusive of VAT.

(2) The cost of individual products is available on each page where they occur irrespective of their description.

Art. 25. Payment for the order to be one of the following ways:

1. By bank transfer: If paying by bank transfer Customer must order payment to the following account of FINTRA Ltd - IBAN: BG27STSA93000015978608, BIC: STSA BGSF, DSK Bank. The payment order must indicate the order number, the date on which it was made, ordered and the total amount due.

2. By debit / credit card via virtual POS terminal (on-line payment):

a) bank cards which you can do on-line payment, with brands Borika, MasterCard and Visa. We need to make sure that your card is open for transactions on the Internet.

b) The maximum amount of the transaction is ......... Euro.

c) Security for the introduction and transmission of card data is produced using the SSL protocol to encrypt the connection between our server and the payment page of our servicing bank

-The authenticity of the card is checked by introducing security code (CVV2)

In addition, to identify you as the cardholder billing server for e-commerce of our servicing bank supports authentication schemes of international card organizations - Veryfied by VISA and MasterCard SecureCode, if you are registered to use them.

d) Data that you should fill in a card payment are:

- Data card (number, expiration date, 3-digit security code, cardholder name, address)

- Data authentication - to identify you as the cardholder billing server for e-commerce of our servicing bank supports authentication schemes of international card organizations - Veryfied by VISA and MasterCard SecureCode. If paying by card via virtual POS terminal client deposit an amount equal to the value of your order and once the deposit transaction is confirmed, delivery of the ordered goods and services will be performed.

Art. 26. Period of execution starts from the first business day following the receipt of the amount due on account of FINTRA LTD.

Art. 27. (1) The customer pays the supplier the cost of goods ordered before the time of delivery.

(2) From the moment the client make the payment of the price prior to delivery of the goods by paying by bank account or via virtual POS terminal and agreeing to these Terms, the same / client / gives his explicit consent to the payment of advances within the meaning of Art. 53 of the Law on Consumer Protection.

Changing prices posted online:

Art. 28. (1) In case of change of prices advertised on the site change is reflected in a clear way for the client, where a specific item indicates old price is crossed out and the new one listed in red.

(2) A change in the price of the goods does not affect contracts already concluded.

VI. DELIVERY

Art. 29. Goods ordered from online catalogs are delivered by courier to the address stated in the request.

Art. 30. (1) The price of the products does not include the amount of delivery. Shipping costs for one item or group of items eligible for group delivery is consistent with the rate detailed in the table on page www.zoneled.de

(2) The shipping cost is paid together with the payment of the goods ordered by the Customer.

Art. 31. Delivery will be made no later than 6 days from the first working day following the date of the price of goods at the expense of FINTRA LTD.

Art. 32. Provider has the right to deliver the goods at delivery instructions of the Customer or a third party that accepts and acknowledges receipt on behalf of the Client and sign the accompanying documents.

Art. 33. If the Customer does not provide the conditions for acceptance of the goods or not be found on the given address in the aforesaid period, the Contractor shall be exempt from the obligation to deliver the goods and provide customer delivery of the goods at their own expense.

Art. 34. Deliveries are not made on weekends and public holidays.

Art. 34. Upon receipt of the goods to the customer and provide the following documents: original VAT invoice, packing slip, bill information under Art. 54 of the Law on Consumer Protection.

Art. 35. (1) The customer must inspect the goods on delivery and transmission to the Supplier if the product does not comply with the order to notify Provider immediately.

(2) If the Customer fails to notify under par. 1, the product is considered approved as compliant except for latent defects. For customers having quality consumer status within the meaning of the Law on Consumer Protection, the provisions and conditions stipulated in the Law on Consumer Protection.

(3) In case of exercising the right of withdrawal for deliveries under par. 1, the cost of returning the goods shall be borne by the Contractor.

Art. 36. (1) If the Contractor can not perform the contract because it does not have the goods ordered, he shall notify the customer and to reimburse its price within 30 working days of the date on which the Contractor should fulfill its obligation under the contract.

(2) In the cases under para. 1, with the consent of the Client, the Contractor shall be entitled to deliver the goods to the Customer of the same type, quality and price.

Art. 37. (1) The supplier transmits goods to the customer after certifying compliance with the requirements and availability of the circumstances under Art. 61 of the Law on Consumer Protection, and then identifying the presence or absence of quality consumer within the meaning of the Law on Consumer Protection.

(2) Client and Provider certifying the circumstances under par. 1 written at the time of delivery by a handwritten signature.

(3) Client and Provider agree that the requirements of para. 1 and Art. 61 of the Law on consumer protection will be met if the certification is made by the person who may reasonably be inferred that it would pass the information to the user - a party to the contract.

 

VII. TERMINATION

Art. 38. This contract shall be terminated in the following cases:

- Its implementation;

- By mutual consent of the parties expressed in writing;

- Objective inability of any of the parties to fulfill their obligations thereunder;

- In other cases provided by law.

 

VIII. REFUSAL  AND CLAIM REFUND

A) Cancellation

Art. 39. You have the right to cancel this contract within 14 days without explaining the reason for this.

The cancellation period is 14 days from the date on which you have taken the goods, or your representative as your third party, other than the carrier,  has possessed the goods.

To exercise your right of cancellation, you must contact us (Fintra OOD, Iliyansko Shose Str.1 Office 26, 1220 Sofia, Bulgaria, Email: office@zoneled.de, +35929633408) (eg, consigned by a clear statement in the mail letter, fax or email) to inform us about your decision to withdraw from this contract,. You may use the attached sample withdrawal form which is not mandatory, however. In order to observe the period of cancellation of the purchases is enough to send the message on the right of withdrawal before the deadline for withdrawal

Art. 41. Effects of Cancellation

If you withdraw from this contract, we return back you all the payments that we have received from you, including delivery costs (with the exception of the additional costs arising from the fact that you have chosen more expensive type of standard delivery comparing with the delivery cost offered by us), and must be repaid immediately at the latest within 14 days from the date on which the notification about your cancellation of this contract is received by us.

For this repayment, we use the same method of payment that you used for the initial transaction, unless you explicitly agreed otherwise; in any case you will be charged fees for this repayment. We may withhold the reimbursement until we have received the goods back or until you have proved that you dispatched the goods, whichever is the earlier.

In any case, you must return the goods promptly not later than the 14th day until you have claimed withdrawal at:

The deadline is met if you send back the goods before the deadline of 14 days. You bear the direct cost of returning the goods.

You need to for any loss of value of the Goods only arise if this loss in value on a review of the nature, characteristics and functioning of the Goods is not necessary to deal with them.

Art. 42. The right of withdrawal does not exist: If the purchase is made by the legal entity/ company/ for execution of its professional jobs.

B) Cancellation of Order

Art. 43. (1) In the event that the Customer wishes to cancel an  order or any product in it or exchange a product ordered, he should get on the phone as quickly as possible (no later than 6 hours after the order) to inform FINTRA Ltd and wish to confirm in writing via e-mail. The client needs to notify the order number for which a correction refers. Client has no right to refuse an order if it has already been sent by courier.

(2) In case of contract denial of an order  FINTRA Ltd undertakes to reimburse the customer within 14 working days.

C) Claims

Art. 44. (1) The customer is entitled to claim for any lack of conformity with the contract.

(2) Upon filing of a claim of good customer can claim a refund, replace the product with another, compatible with the Treaty, rebates or free adjustments / repairs.

(3) The customer is entitled to claims if the defects are not a result of his misconduct, and if there is no damage to the goods caused by improper use.

(4) Upon filing of the claim the customer must apply to the documents on which the claim is based: a receipt or invoice, records, deeds or other documents establishing compliance of the goods or services with the contract, other documents establishing the claim amount is determined.

(5) Customer having as consumer within the meaning of the Law on consumer protection may bring a claim within the deadlines specified in the Law on Consumer Protection. For customers, there is no quality consumer are applicable deadlines specified in the Law on Obligations and Contracts.

(6) Transportation costs to return the item in the event of a claim will be at the expense of FINTRA LTD.

 

IX. PRIVACY POLICY

Art. 45. (1) The Contractor shall take measures to protect the personal data of the Customer under the Protection of Personal Data.

(2) For security reasons, the privacy of client data, provider will send at only e-mail address that was specified by the Customer at the time of registration / order.

 

Art. 46. (1) At any time Supplier may require the Customer to verify the legitimacy and credibility of each advertised during the registration / order the circumstances and personal data.

Art. 47. Each client, by accepting these Terms, and agrees to the collection and processing of personal data for marketing purposes and is considered to be notified under the Act on the Protection of Personal Data that personal data will not be disclosed to other party, unless the information is requested by authorized state body under the statutory procedure or has received express consent from the Client accordingly.

Art. 48. No part of this information, including e-mail addresses of customers will not be used for advertising to third parties in any form. However FINTRA Ltd bears no responsibility for the security of personal information transmitted via this web site, in case of unauthorized intervention of third parties.

Art. 49. The customer may not use someone else's personal information (an alias, a foreign address, e-mail, another credit card, etc.). Each customer who commits such an act will be submitted to the competent authorities of FINTRA Ltd. and will be punished to the fullest extent of European and local legislation.

 

X. AMENDMENT AND ACCESS TO THE GENERAL CONDITIONS

Art. 50. (1) FINTRA Ltd reserves the right to unilaterally modify at any time the website e-commerce www.zoneled.de, and these Terms to use it, by updating this document after the change to update the date of publication.

(2) Customer's obligation is to meet the actual conditions of use and current Terms because they are binding on him.

(3) Changes in the Terms shall not affect the relationship between client and FINTRA Ltd., arising in connection with contracts validly entered into before the change of terms and conditions.

 

XI. RESPONSIBILITY

Art. 51. Provider shall not be liable in the event of force majeure, fortuitous events, issues on the internet, technical or other objective reasons, including orders of the competent authorities.

Art. 52. (1) The provider is not liable for material or immaterial damages, resulting in lost profits or damages caused to the Customer by use or non-use of www.zoneled.de and contracts of sale with the Contractor, unless acted with intent or gross negligence.

(2) The provider is not responsible for the time during which www.zoneled.de unavailable due to force majeure.

Art. 53. (1) The supplier shall not be liable if, in the case of any address security of the equipment followed the loss of information, dissemination of information, access to information, restricting access to information and other related consequences.

(2) The supplier shall not be liable in the event of a contract of sale, providing access to information, loss or alteration of data, the result of the false legitimacy of a third party which is presented to the Client if the circumstances can suggests that this person is a client.

Art. 54 The supplier shall not be liable if the Customer has not read these Terms.

Art. 55. Customer understands and accepts the fact that only FINTRA Ltd provides services and is not responsible for any interference or technical problems, thwarting the use of services due to the operation of computers and the Internet.

Art. 56 FINTRA Ltd. is not responsible for unfaithfulness of that manufacturer's information on the characteristics of goods offered online.

Art. 57. The Web site may contain links to third party sites. FINTRA Ltd. is not responsible for the content, the rules for privacy and security of such sites. Links to other website does not imply that FINTRA Ltd endorses the site and the information contained therein or the products or services for which it is related.

 

XII. OTHER CONDITIONS

Art. 58. The colors of the products shown on this site www.zoneled.de depend on the settings of your monitor.

Art. 59. The content of this website and technologies used in it are protected by the Copyright Act and related rights. All text, graphics and videos posted on the site are the property of FINTRA Ltd unless expressly stated otherwise. The use of any material posted on this site is strictly prohibited. Violators will be prosecuted to the fullest extent of the law.

Art. 60. (1) Client and Provider shall protect each other's rights and legitimate interests and to protect their trade secrets come to their knowledge in the course of performance of the contract and these terms and conditions.

(2) Client and Provider shall, during and after the period of the contract is not made public written or oral communications held between them. For public can be considered the publication of correspondence in print and electronic media, internet forums, personal or public web sites and more.

Art. 61. In the event of a conflict between these Terms and terms and conditions in a special contract between the Supplier and the Client shall take precedence of the special contract clauses.

Art. 62. Possible invalidity of any provision of these Terms shall not invalidate the entire contract.

Art. 63. These terms and conditions are in accordance with the Law on Consumer Protection, Law on Protection of Personal Data and the current Bulgarian legislation. For this outstanding contract issues related to the implementation and interpretation of this contract shall be governed by the laws of the Republic of Bulgaria.

Art. 64. These general conditions shall come into force on 07.June.2012
